These Terms of Service (“Terms”) govern your use of the BloodSense services. Please read them carefully.

1. Your agreement

Welcome to BloodSense. These Terms are a binding legal agreement between you and SMC (“Bloodsense,” “we,” “us,” or “our”). They govern your use of our website, Bloodsense.ai (the “Site”), and our related lab result explanation services (the “Services”).

By accessing or using our Services, you agree to comply with and be bound by these Terms and our Privacy Policy. If you do not agree to these conditions, you may not use our Services.

2. The Bloodsense service

  • 2.1. Our service

    Bloodsense is an AI-powered software solution developed by SMC, a company registered in England and Wales (Number: 15309552). It is designed to help you understand lab analysis reports (blood, urine, and stool) by providing simplified explanations.

  • 2.2. IMPORTANT MEDICAL DISCLAIMER

    Your health is our priority, which is why this disclaimer is a critical part of our Terms.

    • The Service is an informational tool only and is NOT a medical device

    • The information provided is for educational purposes and does not constitute a medical diagnosis, advice, or a substitute for professional medical consultation.

    • You must always consult a qualified healthcare provider for any health decisions and not delay seeking medical advice based on our Service.

 

3. Access and user accounts

  • 3.1. Age requirement: You must be at least 18 years old to use the Services. Your use of the Services confirms you meet this requirement.

  • 3.2. Accurate information: You agree to provide accurate and complete information when using our Services, including your name, email, and lab report PDF, as detailed in our Privacy Policy.

  • 3.3. Patient portal: We may create a secure account for you in our future “Patient Portal” to access past reports. We will notify you when this feature is available, and you will be responsible for keeping your login credentials confidential.

 

4. Permitted use

  • 4.1. Your license: We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal, non-commercial use only. This includes viewing, printing, and sharing your report with healthcare professionals.

  • 4.2. Prohibited activities – You agree not to use the Services to:

    • Violate any applicable laws or infringe on third-party rights.

    • Impersonate any person or entity.

    • Attempt to reverse-engineer, decompile, or discover the source code of our technology.

    • Use any automated process, such as “scraping,” to extract data from the Site.

    • Interfere with the security or integrity of our Services or develop a competing product.  

 

5. Your content and data

  • 5.1. Your input data: You are solely responsible for the information and files you upload (“Input Data”). You retain full ownership of your Input Data and guarantee you have the right to provide it to us.

  • 5.2. AI-generated output data: We assign to you all our rights and interest in the AI-generated report (“Output Data”) created specifically for you.

  • 5.3. Understanding AI-generated content: You acknowledge that AI is a probabilistic technology and may produce errors or information that is not unique. The Output Data is for informational guidance only and is never a substitute for professional medical advice.

 

6. Fees, payment, and refunds

  • 6.1. Pricing: All services require payment as displayed on the Site at the time of your order. You must provide valid payment information to our third-party payment processor, Stripe. We do not store your full credit card details.

  • 6.2. Future subscriptions: We currently offer single-report purchases. If we introduce subscription plans in the future, all relevant terms will be clearly communicated.

  • 6.3. Refund policy: Due to the immediate digital delivery of our Service, all sales are final. We do not offer refunds once report generation begins. If you encounter a technical malfunction, please contact us at contact@bloodsense.ai, and we will review your request on a case-by-case basis.

 

7. Termination

  • Your rights: You can stop using the Services at any time. 

  • Our rights: We reserve the right to suspend or terminate your access to the Services at any time if you breach these Terms, create a security risk, or if we are required to do so by law. 


8. Disclaimers and limitation of liability

  • 8.1. “AS IS” SERVICE: THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

  • 8.2. LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMITTED BY LAW, SMC AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.


9. Governing law and disputes

  • 9.1. Governing law: These Terms are governed by the laws of England and Wales. Any legal action you initiate against us must be brought before the courts of England and Wales.

  • 9.2. Changes to these terms: We may modify these Terms at any time. If we make material changes, we will provide you with notice before they become effective. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.


10. General provisions

These Terms, along with our Privacy and Cookie Policies, represent the entire agreement between you and SMC. You may not assign your rights under these Terms without our consent. If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
